What is unemployment insurance?

Unemployment insurance is a benefit provided by the government to workers who are unfairly laid off.

This benefit aims to guarantee a temporary income to help the worker while they look for a new job opportunity.

And unemployment insurance is also valid for indirect termination, which is when the employee “fires” the employer due to non-compliance with the terms of the employment contract.

However, not every worker who is dismissed without just cause is entitled to receive unemployment insurance.

There is a minimum amount of time required for you to have worked for the company in order to be entitled to unemployment insurance payments.

Who can receive?

Even though one of the main criteria required to receive unemployment insurance is having worked with a signed contract for at least 6 months, this is not enough.

If you have worked for 6 months, you will be entitled to unemployment insurance payments, however, you will need to meet certain requirements.

Find out what they are:

  • Having been dismissed without just cause or through indirect termination;
  • You must be unemployed when you apply for the benefit;
  • In the case of the first request, having worked for at least one year in the last 18 months;
  • And in the case of the second request, you will need to have worked for at least 9 months in the last year;
  • Having worked with a signed employment contract in the last 6 months, this applies to the third request;
  • Not having your own income to support yourself and your family;
  • Not receiving any type of continued social security benefit, except for survivor's pension and accident benefit.

How long does it take to apply for my insurance?

In summary, from the requirements mentioned above, it is clear that to receive unemployment insurance you will need to have worked for a certain amount of time.

In other words, for the first application you will need to have at least 12 months of employment.

In the second application for unemployment insurance, the period of employment is reduced to 9 months.

And from the third request onwards, this number drops to 6 months of work with a signed contract.

However, be aware of the time required between one request and another, which is at least 16 months.

What are the rules for maintaining unemployment insurance?

 The benefit can only be maintained during the period in which the worker is not working, that is, without exceeding the time of the established installments relating to the working time.

Therefore, to ensure that you do not lose your unemployment insurance before the time it was granted, pay attention to some rules.

Failure to comply may result in the cancellation of your unemployment insurance.

  • Providing false information, such as name and CPF or other data that could lead to obtaining the benefit fraudulently;
  • Fraud the termination of the contract to which the period refers;
  • Receive other remuneration with a formal or informal employment relationship while receiving unemployment insurance;
  • Start receiving social security benefits, except accident assistance and survivor's pension;
  • Being admitted to a new job.

When you are hired for a new job while you are receiving unemployment insurance, it is automatically cancelled.
