In Brazil there are different types of employment contracts, the most traditional of which is the CLT contract.

This type of contract is for an indefinite period and, in addition, the worker has his/her work card signed.

Because of this, both the employer and the employee have certain duties and rights provided for in the CLT, Consolidation of Labor Laws.

What is CLT?

The number of people working informally surpassed the number of those working with a formal contract between mid-2021 and early 2022.

This is because, in 2021, the number of jobs with formal contracts fell significantly due to the crisis in Job Market caused by the pandemic.

As a result, the number of people who found informal work, that is, without registration, as an alternative to supporting their households also increased.

In fact, it was one of the reasons why the unemployment rate fell by more than 8% in the same period, according to data from IBGE.

However, this class of workers ends up working without having their rights protected by law, in many cases, even in the face of injustices and irregularities.

Since workers under the CLT regime have access to labor laws and enjoy some of the benefits it stipulates, for example, the right to vacations, licenses and thirteenth.

CLT is a type of employment contract governed by a series of laws that regulate labor relations and also protect workers.

Among the rights guaranteed by the CLT, we can find _ in addition to those already mentioned a little earlier _ working hours, minimum wage, FGTS, PLR and dispute settlement.

In short, it is important to define rules between employees and companies; that is, what may or may not be included in an employment relationship, what are the duties, obligations and also rights of those involved.

The law also serves to monitor and ensure that the topics are complied with, and thus, provide better conditions in the job market.

Who created the CLT?

On May 1st, our CLT will complete 80 years of approval. It was approved and signed by President Getúlio Vargas and presented by Decree – Law No. 5,452.

The CLT was created with the aim of protecting workers, but also unifying all laws related to work in the country, as the name itself suggests.

Now that you've discovered what is CLT and who created it, discover a little about its importance below.

What is its importance in society?

importância da clt

Before the CLT, labor laws already existed in Brazil. The first national labor law appeared in the 19th century, being signed by then president Deodoro da Fonseca, who served from 1889 to 1891.

It prohibited children under 12 from working in factories in Rio de Janeiro. In 1907, the creation of unions for workers in different fields was authorized, among other laws that were emerging.

However, despite the fact that many labor laws already exist, the main problem is that many of them were not enforced.

With the CLT, the legislation in force in the country was expanded and consolidated, and also put into practice.

Informal workers cannot demand vacations, thirteenth salary, licenses, that is, they have no stability.

If you work for yourself and need to take a vacation or receive a thirteenth salary, for example, you need to plan for the whole year and save money.

If you have an accident, you will be out of work and have no income while you recover.

Another example is that you do not receive overtime or night shift pay if you exceed your working hours, if you have a fixed time to start and finish work.

The CLT is important for imposing rules and limits on labor relations and protecting workers.

If you own your own business, you know how rewarding but difficult it can be.

Mainly due to the lack of stability, it is therefore important to plan carefully, especially financially, to enjoy the benefits and protections that a formal job brings.
